Condominium in Spain: How the Owners' Association Works

Understand how expenses and participation work in owners' associations in Spain to avoid surprises in your monthly budget and property management. When you move to Spain and acquire a property, you automatically become part of an "Comunidad de Propietarios". Unlike Brazil, where the term "condominium" is used broadly, here the concept is governed by horizontal property law. Understanding how this works is essential for keeping your finances in order and knowing how to participate in decisions about your building.

What are community expenses?

Community expenses are the necessary costs for the operation, conservation, and maintenance of a building. This includes services such as cleaning common areas, lighting, elevator maintenance, security (when available), and any insurance or structural renovations. These amounts cover the loads and responsibilities that affect the entire building.

How is the calculation and division of expenses made?

The main rule in Spain is that expenses are shared among all owners according to their "cuota de participaciĂłn". This coefficient is not random; it is defined at the time of construction of the building and registered in the Constitutive Title.

The calculation of the quota takes into account factors such as:

  • The useful surface area of each apartment or commercial space relative to the total property area.
  • The location of the unit within the building (interior or exterior).
  • The rational use expected for common elements or services.

If you live in a larger apartment, your participation quota will be proportionally higher than that of a neighbor with a smaller unit, which dictates how much you will pay monthly for maintaining the building.

Is there flexibility in the division?

Although the participation quota is the norm, there are exceptions. It is possible that the community's statutes define a specific distribution system or that certain units (such as ground-floor shops) may be exempt from paying for services they do not use, such as staircase cleaning or elevator usage.

For a change or exemption to be valid, it must be clearly described in the Constitutive Title or in the Statutes. If there is no specific rule, the Board of Owners can decide on changes, provided that the decision is made unanimously and respects what is established by the Law of Horizontal Property.

The role of the Board of Owners

The Board of Owners is the governing body where neighbors meet to decide on the annual budget, approve works, and elect representatives. Participating in these meetings is a right and a way to follow how your money is being managed. If you are an owner, remember that it is through the Board that collective decisions gain legal force and become mandatory for all members of the community, ensuring that everyone's property is preserved appropriately according to current regulations.
