The Spanish job seeker visa: what actually exists

"Does anyone know how to apply for the job seeker visa?" This is one of the most common questions in WhatsApp groups for Brazilians in Spain — and also one of those that generates the most incorrect answers, because the subject changes from month to month and most texts on the internet write as if it were already operational. We went straight to the official sources — Boletín Oficial del Estado, Ministerio de Inclusión, Seguridad Social y Migraciones, SEPE — to separate what is actually in force from what is just a provision in the law, and from what happened only once, years ago, and never returned.

What the "job seeker visa" actually is

The official name is autorización de residencia para búsqueda de empleo. It is provided for in the Reglamento de Extranjería (Real Decreto 1155/2024, in force since 20/05/2025), articles 43 to 45. If and when it can be used, it works like this:

• It gives the right to stay for up to 12 months in Spain looking for a job or trying to set up a business.
• It does not authorize working — it only serves to conduct interviews, network, and finalize a proposal. After securing an offer, the employer is the one who files the application for the actual work permit.
• The law provides for two categories of beneficiaries: (1) children and grandchildren of Spaniards by origin, and (2) professionals in specific occupations and territories, defined by ministerial order.

So far, this is what the law says can exist. The problem begins in the next part.

Why neither of the two categories has open slots today

Article 44 of the Reglamento itself states that the number of visas, the selection system, and the application method depend on a ministerial order — the same one that approves the "collective management of hiring at origin" (known as Orden GECCO).

We went straight to the Orden GECCO 2026 (Orden ISM/1547/2025, published in the BOE on 30/12/2025, in force since 1/1/2026) to check. It does not mention job seeking at any point. It only regulates hiring with a closed job offer (the traditional model of "hiring at origin," used historically for seasonal harvests and circular migration programs) — not the search mechanism without a prior offer that article 44 created.

A Spanish law firm specializing in extranjería summarizes the situation like this: the law "authorizes, but does not activate". The legal possibility exists; the administrative act is missing — the number of vacancies, the deadline, the country, the procedure — that would make it work for real.

This has happened before — once, years ago

It is not the first attempt. In 2019, Spain ran a real pilot project for this visa, specifically for children and grandchildren of Spaniards in Argentina: 500 visas initially (with a projection of reaching 1,500), priority sectors in technology, IT, and finance, applications open only between April and May of that year, 3-month visa to look for a job. The official text at the time already stated that "future experiences will be carried out both in Argentina and in other countries with special ties to Spain" — but Brazil was never mentioned, neither then nor later. In 2020, there was a regulatory quota, without a new actual call. From 2021 until today, nothing.

Real Decreto 1155/2024 tried to turn that specific pilot into a permanent pathway — that is where today's article 44 comes from. But, as we have seen, the piece that turns the key is missing.

Keep an eye out: how to know if this changes

There is currently no official announcement with a deadline, number of vacancies, or defined country. If this changes, the signal will not come from a WhatsApp group — it will appear first in these places:

• BOE (Boletín Oficial del Estado) — a new specific ministerial order, or an update to the Orden GECCO that starts mentioning job seeking
• Website of the Ministerio de Inclusión, Seguridad Social y Migraciones — news/migration section
• Publications of Spanish consulates — opening of applications is usually accompanied by consular instruction

Until one of these three appears, it is honest to speak of a legal possibility — not an open vacancy.

The SEPE catalog — what it is, and what it is NOT

Here is the most common confusion: the idea circulates in groups that there is a "list of professions" to apply for the job seeker visa. It does not exist — what exists is something else, useful, but different.

The Catálogo de Ocupaciones de Difícil Cobertura is published by the SEPE (Servicio Público de Empleo Estatal) every quarter (January, April, July, October), province by province. It does not grant the right to come and look for a job — it serves to expedite the work permit for those who already have a closed job offer from a Spanish employer in one of these occupations. It is the employer who files the request, proving that they did not find enough local candidates.

We downloaded and checked the official catalog for the 1st quarter of 2026 directly — not a third-party summary. The result is surprising: there are only 27 distinct occupations in the entire country, and none of them are in the health or technology sector, contrary to what is circulating out there.

Maritime (only in provinces with a coast): naval refrigeration technicians, merchant ship chief engineers, naval engineers, coastal and naval mechanics, merchant ship pilots, ship pursers, radio-electronic officers, ship cooks/waiters/stewards, ship firefighters, boatswains and deck sailors, deckhands.

Construction and electrical (in most provinces, with or without a coast): aluminum/metal/pvc carpenters, metal carpentry assemblers, electrical installers (buildings and general), crane operator-drivers (truck/fixed/mobile), boilermakers, ship machine oilers.

Sports (in practically all provinces): professional athletes, sports coaches.

A real curiosity from the official document itself: Madrid — with no coast whatsoever — appears with the complete maritime list, just like the coastal provinces. We did not find an official explanation for this; it is what appears in the PDF.

The large regions of destination for Brazilians follow the same national pattern — Cataluña (Barcelona), Comunidad Valenciana (Valencia, Alicante), and Baleares (Palma) have the same combination of maritime, construction, and sports, with no vacancies in health, IT, hospitality, or education.

This list changes every quarter and varies by province — what applies today may not apply in October. Before making any decision based on it, consult the official SEPE search tool for your specific province.

The paths that actually work today

Putting it all together: for those who are not a child/grandchild of a Spaniard by origin and did not study in Spain, today there is no "come and look for a job" visa that is actually accessible. What exists, working for real, are three paths — all of them require something closed before coming, not a search:

1. Hard-to-fill occupation (SEPE list) + closed job offer — the Spanish employer requests the authorization, proving that the vacancy is on the list for your province in that quarter.
2. Highly Qualified Professional (Law 14/2013, via UGE-CE) — also requires a closed job offer from a company that has more than 250 employees, has an annual turnover of more than €50 million, or invests more than €1 million/year. Minimum salary in the range of €45-55k/year. Resolution in 20 business days, with positive administrative silence — if they do not respond within the deadline, it is considered approved.
3. Student visa, with the right to work up to 30h/week — compatible with studies, geographically limited to the autonomous community (except for border localities). It is not a work visa, but in practice, it is the only path today that allows one to be in Spain and work without having a closed vacancy beforehand.

There is also a fourth, more restricted path: those who have already completed an undergraduate, master's, or doctoral degree at a Spanish higher education institution (degree obtained in the last 2 years) can apply for a job search authorization from within Spain, in the period between 60 days before and 90 days after the expiration of the student visa. This path is confirmed as operational — but only for those who have already studied there.

Summary — only what can be stated with certainty

• The job seeker visa for descendants of Spaniards and for specific occupations exists in the law, but has no open quota today (10/07/2026).
• It existed once, for real: pilot in Argentina in 2019, never repeated, never extended to Brazil.
• Orden GECCO 2026, which was supposed to activate this path, does not mention job seeking — only hiring with an already closed offer.
• The SEPE Catalog of Hard-to-fill Occupations is not a list to apply for a seeker visa — it is a list to expedite the work permit for those who already have a closed job. Today it has only 27 occupations in the entire country, concentrated in maritime, construction, and sports.
• Those who are not descendants or former students have today, for real: SEPE + closed offer, Highly Qualified + closed offer, or student visa with the right to 30h/week of work.
